Dept. of Education’s Demise is Consequence Of Its Own Bias and Incompetence
March 26, 2025 / WASHINGTON — Last week President Donald J. Trump kept a campaign promise and signed an Executive Order to dismantle the Department of Education. The Executive Order will transfer the Department of Education’s functions to other federal agencies or return the functions to the states. (1)
The Department of Education has expended over $3 trillion since its establishment in 1979. Despite per-pupil spending having increased by more than 245% during that time period (2), there has been virtually no measurable improvement in student achievement:
- Math and reading scores for 13-year-olds are at the lowest level in decades. (3)
- Six-in-ten fourth graders and nearly three-quarters of eighth graders are not proficient in mathematics. (4)
A number of factors contributed to the demise of the Department of Education, such as:
- The 2011 “Dear Colleague” letter eviscerated due process rights of students and faculty accused of sexual misconduct. The letter discouraged cross-examination and mandated a weak “preponderance of evidence” standard of proof. The controversial policy was rescinded in 2017 by the Trump administration. (5)
- The Department of Education disproportionately targeted faith-based universities. For example, in 2023 the Department of Education imposed a $37 million fine on Grand Canyon University, the largest Christian University in the country. (6)
- In 2022 the Biden Administration unexpectedly announced a new Title IX Rule. The action flagrantly violated the Administrative Procedure Act, which requires advance public notice and comment for any proposed regulation. (7)
- When the Biden administration released its new Title IX regulation in 2024, it changed the legal definition of sex to include “gender identity,” triggering opposition from a broad range of groups. Within weeks, 10 lawsuits had been filed to stop the new policy. (8)
- The Department of Education funded numerous D.E.I. (Diversity, Equity, and Inclusion) programs that discriminated on the basis of race and sex. In February, it was announced that the DOE had cut $600 million in DEI grants to schools and non-profit organizations. (9)
Several lawmakers have spoken in support of Trump’s Executive Order to dismantle the Department of Education, including: (10)
- Gov. Jeff Landry: “The United States spends the most on education, yet we are ranked at the bottom of nearly every poll. The time for change is NOW! Thank you President @realDonaldTrump for returning education where it belongs— the states!”
- Sen. Tommy Tuberville: “The federal government doesn’t belong in the classroom, plain and simple. Promises made, promises kept.”
