Title IX Equity Project: Overview


Title IX prohibits sex discrimination in federally supported schools. The law states:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Sex discrimination can take many forms. In Teamsters v. United States, the Supreme Court noted that discrimination is not limited to direct signs that people will see (like “no male students allowed”), but can also include “actual practices” such as how the opportunity is publicized and “recruitment techniques.”

For example, in a case involving a STEM program for middle school girls that was sponsored by Seattle University, the OCR ruled:

OCR’s review of the promotional materials and registration forms for the EYH [Expanding Your Horizons] program do not indicate that boys are prohibited from attending or that boys would be excluded if they registered to attend. However, OCR’s review showed that the promotion materials and the registration form for the SEYH [Seattle Expanding Your Horizons] program used the term “girls” when referring to participants or registrants, which may have the effect of discouraging individuals from participation in the program based on sex.

SAVE’s Title IX Equity Project, launched in 2018, is working to assure that this historic law is fairly and consistently applied.
